IPO consults on UK implementation of the EU Trade Secrets Directive

The Intellectual Property Office has launched has launched a consultation seeking views on the proposed Trade Secrets (Enforcement, etc) Regulations 2018 which will transpose Directive 2016/943/EU (the Trade Secrets Directive) into UK law. The deadline for responses is 16 March 2018.

The Trade Secrets Directive was adopted on 8 June 2016 and came into force on 5 July 2016. It sets out minimum standards for measures, procedures and remedies that should be available in the unlawful acquisition, use or disclosure of trade secrets.

A number of provisions in the Trade Secrets Directive already exist in UK law, so the proposed changes relate primarily to procedural matters in the courts. They are intended to provide clarity, transparency and consistency across the UK’s various jurisdictions. The full text of the Directive is included at:
